The amount of debt for which no guarantee is required when public receivables are deferred and paid in instalments under Article 48 of Law No. 6183 has been raised to TRY 10,000,000 by Presidential Decision No. 11414.
| Subject | Before | Now |
|---|---|---|
| Deferral threshold without guarantee | TRY 250,000 | TRY 10,000,000 |
| Guarantee for debts above the threshold | Half of the excess | Half of the excess |
Law No. 7582 raised the amount in the text of the Law to TRY 1,000,000, and under the power given to the President, the threshold has been set at TRY 10,000,000.
A taxpayer requesting deferral of a total tax debt of TRY 15,000,000 will be asked for a guarantee of TRY 2,500,000, which is half of the TRY 5,000,000 above TRY 10,000,000. No guarantee is required if the debt is TRY 10,000,000 or less.
The guarantee burden has fallen significantly for businesses facing temporary cash flow difficulties. We recommend that taxpayers with overdue tax debts compare the cost of late payment interest with deferral interest and consider applying for deferral.
